Opinion

Beer distributors sought review of decision of state Liquor Control Board upholding citations for sales of mixed brand cases of beer. The Court of Common Pleas, Allegheny County, Nos. S.A. 1572–1579 of 1993, Scheib, J., reversed. Bureau of Liquor Control Enforcement appealed. The Commonwealth Court, Nos. 1000–1003, 1005–1008 C.D. 1994, Rodgers, Senior Judge, held that statute requiring beer to be sold in original containers as prepared by manufacturer prohibited distributors from selling cases of mixed brands of beer combined by distributors from damaged original cases. Reversed. Pellegrini, J., filed dissenting opinion. Procedural Posture(s): On Appeal
